Plastimayd Pool Products warrants to the original retail consumer purchaser that the ULTRA-MAYD™ vinyl liner to be a product of high quality material and workmanship. Subject to the conditions set out herein it agrees, at its option, to replace or repair the pool liner at no charge if there is any defect in the workmanship or the vinyl material (as described below) within the first three years of the original date of purchase F.O.B. its factory. The warranty determination of repair or replacement shall be solely at the discretion of Plastimayd Pool Products. This warranty does not include surface staining, notable changes to, or fading of decorative print, damage or failure resulting from other causes including, but not limited to, improper installatoin, damage caused by gross misuse of chemicals, acts of God, fire, ice damage, improper cleaning, accident or negligence, misuse or abuse.

Defects in workmanship or material under warranty are comprised of the following:

  1. Faulty workmanship in fabrication of the liner (welding of seams)
  2. Notable changes to base film of vinyl (including fading and degradation of the vinyl.)

During the first three years after the date of purchase, there shall be NO CHARGE to the original purchaser/consumer for repair or replacement. Therein after, a charge will be made. This charge will be a percentage of the retail price in effect at the time of replacement or repair. Percentages are based on the length of time from date of purchase. The following schedule sets forth the percentage rate:

First 3 years

- 50%		 After 8 years
- 70%		 After 10 years
- 90%
After 3 years
- 20%		 After 5 years
- 40%		 After 7 years
- 60%		 After 9 years
- 80%		 After year 11 to year 15
- 95%

Plastimayd Pool Products shall not be responsible for the cost of removal or replacement of any defective liner, nor any other expenses or for damages which might be incurred in such removal and replacement. This warranty is enforceable only by the original retail consumer purchaser and applies only to liners purchased for private, residential use.

This warranty will be constituted under the law of the United States. Plastimayd Pool Products shall in no event be liable for consequential damages or contingent liabilities arising from the failure of the liner or any product or its accessories to operate properly. Plastimayd Pool Products shall not be liable for any consequential or incidental damages, including, but not limited to any damages for loss of use of pool or injury to person or property, and any claims therefore are hereby specifically disclaimed or excluded.

This warranty excludes all other implied warranties upon which this liner is sold. It is further agreed and understood that Plastimayd Pool Products' liability shall be limited to its agreement to repair or replacement as aforesaid, all other damages, whether proximate or not, and warranties, statutory, implied or otherwise, being hereby expressly waived by the purchaser.

If a Plastimayd liner should fail during the warranty period as a result of a manufacturing problems covered by this warranty, the consumer purchaser will notify Plastimayd Pool Products in writing by mail. This notice will contain (1) the liner serial number (2) date of purchase (3) and description of defect. Plastimayd will determine if the liner is to be returned to the factory or will ask that the defective area be cut from the liner along with the part of the liner stamped with the serial number. Liner, or liner pieces must be cleaned and returned freight prepaid to Plastimayd Pool Products, PO Box 2320, 14151 Fir St., Oregon City, OR 97045. Replacement liners will be shipped freight collect.

Except as specifically set forth above, Plastimayd Pool Products makes no warranty, expressed, or implied, including the warranty of merchantability or fitness for a particular purpose. No representative of Plastimayd Pool Products, nor any of its agents, distributors or dealers has any authority to alter in any manner the terms of this warranty and Plastimayd Pool Products is not responsible for any undertaking, representation or warranty made by any other person beyond those expressly set forth in this warranty certificate.

ATTENTION INSTALLER: This warranty must be given to Pool Owner at time of installation.
